The recent decision by the Court for the Repression of Economic and Financial Offenses (CRIEF) to refuse medical evacuation abroad of former Prime Minister Ibrahima Kassory Fofana raises serious concerns about the respect of fundamental human rights in Guinea. Accused of embezzlement of public funds, illicit enrichment and corruption, Dr. Fofana has been detained since April 2022. His health has seriously deteriorated, to the point that his lawyers claim that he is unable to appear before the CRIEF and requires specialized care unavailable in the country. In December 2024, the CRIEF had initially authorized his transfer to the American Hospital of Paris, recognizing the absence of adequate medical facilities in Guinea to treat his condition. However, this decision was reversed following the recusal of Judge Yacouba Conté, replaced by Lansana Soumah, who ordered a new in-person appearance of Dr. Fofana, despite his critical health condition. Mr. Fofana’s lawyer, Dinah Sampil, denounced this situation, stating: “The judge, because he simply had the courage to order the evacuation of Mr. Fofana, was recused. Because he did not follow the recommendations of the special prosecutor, who is still opposed to this evacuation.” He also emphasized that his client is physically unable to appear, given that he can neither sit nor stand due to his illness. This situation highlights major concerns regarding the independence of the Guinean judicial system and respect for human rights. The refusal to allow appropriate medical care to a detainee, especially when such care is not available locally, constitutes a violation of international human rights standards. It is imperative that the Guinean authorities ensure that judicial decisions are made independently and without political interference, while ensuring respect for the fundamental rights of individuals, including the right to health. The international community and human rights organizations must remain vigilant in the face of this situation and urge the Guinean transitional government to respect its international human rights commitments. It is essential that Dr. Ibrahima Kassory Fofana receives the necessary medical care, in accordance with medical recommendations, in order to preserve his health and dignity. Lancine SACKO
