LETTER to His Excellency the President of the Transition Head of State of the Republic of Guinea Excellency, Mr. President of the Transition, The NGO Lawyers for Africa “APA”, engaged in actions and initiatives for the respect of the rights of Africans and Africa and the universal principles of justice and respect for human dignity, is challenged and concerned by the state of health of Dr. Ibrahima KASSORY FOFANA, a Guinean-American national, former Prime Minister of the Republic of Guinea, indicted and currently admitted to a hospital in Guinea Conakry.

Without wishing to interfere in the criminal proceedings opened against him or to rule on the grievances held against him, our organization calls on the authorities of the Transition in Guinea Conakry to accede favorably to the opinions of the medical team examining him in that it strongly recommends his medical evacuation to a medical unit that can provide him with appropriate and adequate care. The NGO Lawyers for Africa recalls that the Republic of Guinea is a signatory to international and African legal instruments that guarantee Guinean citizens the right to health, dignity and respect for the principle of presumption of innocence. The circumstances and even the seriousness of the facts likely to be retained in the context of the legal proceedings opened against him, in accordance with the essential fundamental requirements for fair, humane and universal justice, cannot justify an infringement of his right to health. For these humanitarian considerations, we request your intervention to allow Mr. Ibrahima KASSORY FOFANA to benefit from his rights as defined and guaranteed by international and African law and other international commitments signed by your country for which you are the guarantor. Thanking you for the follow-up that you will kindly reserve for this We ask you to accept, Excellency Mr. President of the Transition, Head of State of Guinea, the expression of our high consideration.

Excellence, Monsieur le Président de la Transition,

L’ONG Avocats Pour l’Afrique « APA », engagée dans des actions et des initiatives pour le respect des droits des africains et de l’Afrique et des principes universels de justice et de respect de la dignité humaine est interpellée et préoccupée par l’état de santé du Dr Ibrahima KASSORY FOFANA, ressortissant guinéen – américain, ancien Premier Ministre de la République de Guinée, inculpé et actuellement admis dans un centre hospitalier en Guinée Conakry.

Sans vouloir s’immiscer dans la procédure pénale ouverte à son encontre ni se prononcer sur les griefs retenus contre lui, notre organisation sollicite les autorités de la Transition en Guinée Conakry d’accéder favorablement aux avis de l’équipe médicale qui l’examine en ce qu’elle recommande instamment son évacuation sanitaire dans une unité médicale pouvant lui assurer des soins appropriés et adéquats.

L’ONG Avocats Pour l’Afrique rappelle que la République de la Guinée est signataire des instruments juridiques internationaux et africains qui garantissent aux citoyens guinéens le droit à la santé, à la dignité et au respect du principe de présomption d’innocence .

Les circonstances et même la gravité des faits susceptibles d’être retenus dans le cadre des poursuites judiciaires ouvertes lui , conformément aux exigences essentielles fondamentales pour une justice équitable, humaine et universelle , ne peuvent justifier une atteinte à son droit à la santé.

Pour ces considérations humanitaires, nous sollicitons votre intervention pour faire bénéficier à Monsieur Ibrahima KASSORY FOFANA ses droits tels qu’ils sont définis et garantis par le droit international et africain et les autres engagements internationaux signés par votre pays auxquels vous êtes le garant.
